§ 1. General Provisions

1. These terms of service (hereinafter "Terms") define the rules and conditions for the provision of services by electronic means by the company Techcom Serwis Sp. z o.o. with its registered office in Płock at ul. Torowa 2, 09-407 Płock, VAT ID: 7743225131, REGON: 362810997, KRS: 0000582071 (hereinafter "Service Provider") via the website available at www.techcomserwis.com (hereinafter "Service").

2. The definitions used in the Terms mean:

  • Service Provider: Techcom Serwis Sp. z o.o. as defined in point 1.
  • Service: The Service Provider's website available at www.techcomserwis.com.
  • User: Any natural person with full legal capacity, a legal person, or an organizational unit without legal personality, to which the law grants legal capacity, using the Service.
  • Services: Services provided by the Service Provider by electronic means via the Service, in particular providing informational content, enabling contact through forms, and subscribing to the newsletter.
  • GDPR: Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.

3. The Terms are made available to Users free of charge via the Service in a form that allows them to be downloaded, saved, and printed.

§ 2. Types and Scope of Services Provided Electronically

1. The Service Provider provides the following Services via the Service:

  • Providing informational content about the Service Provider's activities, offered products, and services.
  • Enabling Users to contact the Service Provider using the contact form and the request for quotation (RFQ) form.
  • Enabling subscription to the Newsletter to receive commercial and marketing information (optional service, requiring separate consent).
  • Enabling the download of informational and technical materials available on the Service (e.g., in the Knowledge Center).

2. The use of the Services is voluntary and generally free of charge. The User only bears the costs associated with access to the Internet, according to their operator's tariff.

§ 3. Conditions for Providing Services

1. The technical requirements necessary for cooperation with the ICT system used by the Service Provider are as follows: a) an end device (computer, tablet, smartphone) with access to the Internet, b) an up-to-date version of a web browser (e.g., Chrome, Firefox, Edge, Safari) with JavaScript and cookies enabled.

2. The Service Provider reserves that the use of some Services may require the User to provide certain data, including personal data.

3. The User is obliged to use the Service in a manner consistent with the law, good practices, the provisions of these Terms, and in a way that does not infringe the rights of the Service Provider and third parties.

4. It is forbidden for the User to provide content of an unlawful, offensive nature, or content that violates personal rights or the principles of social coexistence.

§ 4. Conditions for Concluding and Terminating Service Agreements

1. The agreement for the provision of the Service consisting of access to the informational content of the Service is concluded at the moment the User starts using the Service (enters the website). This agreement is terminated when the User leaves the Service.

2. The agreement for the provision of the Service consisting of using the contact form or RFQ is concluded at the moment the form is correctly filled out and sent by the User. This agreement is of a one-time nature and is terminated upon sending the inquiry or immediately after the Service Provider responds, depending on the nature of the inquiry.

3. The agreement for the provision of the Newsletter Service is concluded at the moment the e-mail address is provided, consent to receive commercial information is given, and the subscription is confirmed (if a double opt-in mechanism is used). The User may terminate the Newsletter Service agreement at any time by clicking the unsubscribe link in each Newsletter message.

§ 5. Liability of the Service Provider

1. The Service Provider will exercise due diligence to ensure the proper functioning of the Service, but does not guarantee its uninterrupted availability and is not liable for any disruptions in the functioning of the Service caused by force majeure, technical failures, unauthorized interference by Users or third parties.

2. The Service Provider is not responsible for the content of information from third parties that may be published on the Service (e.g., in blog comments, if enabled).

3. The Service Provider is not liable for damages resulting from the User's use of the Service in a manner contrary to the law or the provisions of the Terms.

§ 6. Personal Data Protection

Detailed rules for the processing of personal data of Service Users and the cookie policy are set out in the Privacy Policy document, which is an integral part of these Terms.

§ 7. Copyright

1. All rights to the Service, including its textual, graphical elements, page layout, and databases, belong to the Service Provider or cooperating entities and are protected by law, in particular by the Act of February 4, 1994 on Copyright and Related Rights.

2. The use of the Service by Users does not mean the acquisition of any rights to the Service or its content. It is forbidden to copy, modify, distribute, transmit, or use in any other way the content of the Service without the prior written consent of the Service Provider, except for permitted personal use.

§ 8. Complaint Procedure

1. Any complaints regarding the operation of the Service or the Services provided through it may be submitted by the User electronically to the e-mail address: reklamacje@techcomserwis.pl or in writing to the address of the Service Provider's registered office.

2. A complaint should contain at least the User's identification data (name, surname, e-mail address), a description of the subject of the complaint, and the reported objections.

3. The Service Provider will consider the complaint within 14 days of its receipt and inform the User about the method of its resolution.

§ 9. Final Provisions

1. In matters not regulated in these Terms, the provisions of generally applicable Polish law shall apply.

2. The Service Provider reserves the right to make changes to the Terms for important reasons (e.g., change in legal regulations, change in the scope of services provided). The Service Provider will inform Users of any change by posting information on the Service. The changes come into force on the date specified by the Service Provider, not less than 7 days from the date of informing about the change.

3. Any disputes arising between the Service Provider and a User who is not a consumer will be submitted to the court competent for the registered office of the Service Provider.

4. The Terms come into force on January 8, 2025.
